Background: Informed consent is a legal as well as ethical prerequisite in clinical research. For dementia research, informed consent can be a problem if subjects with dementia, whose capacity for understanding and thus also decision making might be limited, are to be exam- ined. This might result in exclusion of dementia patients from research, as capacity for understanding and decision making are often equated with the ability for rational decision making. However, this valuation has been criticized at times for attaching (...) too much impor- tance to the cognitive aspect of decision making. -/- Methods: This qualitative study investigates the actual consent procedure of a clini- cal research study in Germany with regard to dementia patients’ subjective and objective understanding of informed consent information. Research participants were ten dementia patients, who volunteered in two clinical research studies, as well as their caregivers. Data were collected by use of semi-structured interviews. -/- Results: It was determined that the patients’ comprehension of informed consent infor- mation was rather limited. However, a number of patients were quite aware of this. In con- trast, all caregivers claimed to have fully understood the provided information, while their objective comprehension was also incomplete. Several participants indicated that they did not attach much importance to the information given in the consent procedure and that their consent did not primarily depend on this information. Rather, participation in the research study for them seemed to be more of a problem-focused coping strategy for dealing with their diagnosis of dementia. -/- Conclusion: For research ethics these results raise the question whether the currently prevailing emphasis on the cognitive aspect of autonomous decision making, i.e., compre- hension, may be too one-sided, and to what extent the “volitional” aspect in giving consent should be given greater consideration. In a recently published article A. Nordmann highlighted the fact that Hertz considered it as the greatest pleasure of scientific research to be “alone with nature” and to learn “directly from nature” (see Nordmann, 1998, p. 156). Hertz contrasts this being on his own with nature with the “disputes about human opinions views and demands. (see Nordmann, 1998, p. 156) . It is this contrast between nature on the one hand and human beliefs etc. on the other that is fundamental (...) for his central epistemological pursuit: the attempt to sort out which features of our theories can be attributed to nature as opposed to those which depend on us. I will discuss the various writings in which Hertz touches this subject. (shrink)

Edmund Husserl is regarded as the founder of transcendental phenomenology, one of the major traditions to emerge in twentieth-century philosophy. In this book Andrea Staiti unearths and examines the deep theoretical links between Husserl's phenomenology and the philosophical debates of his time, showing how his thought developed in response to the conflicting demands of Neo-Kantianism and life-philosophy. Drawing on the work of thinkers including Heinrich Rickert, Wilhelm Dilthey and Georg Simmel, as well as Husserl's writings on the natural and (...) human sciences that are not available in English translation, Staiti illuminates a crucial chapter in the history of twentieth-century philosophy and enriches our understanding of Husserl's thought. Wir rekonstruieren einen signifikanten Strang von Max Benses früher intellektueller Entwicklung über sein Verhältnis zu Oswald Spengler, David Hilbert und Heinrich Scholz. Nach einer kurzen Rekapitulation von Spenglers kulturrelativistischem Bild des Mathematischen folgen wir einigen Spuren der Spengler-Lektüre in Max Benses frühen Texten und zeigen, wie sich Bense unter dem Einfluss von Heinrich Scholz ab Ende der 1930er Jahre sukzessive von Spengler distanziert und schließlich ein Konzept ‚reiner Wissenschaft‘ ausbildet, wie es sich unter anderem in David Hilberts formalistischer (...) Mathematik Ausdruck verleiht. Die Verteidigung Hilberts gegen völkische Denker wie Max Steck ist einer der Schauplätze, auf denen Scholz und Bense gemeinsam ihren Weltanschauungsdissens zur NS-Wissenschaftsauffassung artikulieren, gleichwohl sind auch sie Teil des NS-Wissenschaftssystems. In this paper I argue against readings of Hertz that overly assimilate him into the thought of late 20th century anti-realists and pluralists. Firstly, as is well-known, various images of the same objects are possible according to Hertz. However, I will argue that this envisaged pluralism concerns the situation before all the evidence is considered i. e. before we can decide whether the images are correct and appropriate. Hertz believes in final and decisive battles of the kind he participated in (...) while doing experiments in electrodynamics. Secondly, I will argue that the concept of representation is still quite appropriately applied to important aspects of images, namely when it comes to fundamental physical equations. In this context Hertz explicitly allows that “characteristics of our image, which claim to represent observable relations of things, do really and correctly correspond to them” (Hertz [1894] 1956, 9). A final consideration is Hertz’s consistent appeal to the concept of the hypothesis. I will argue that his use of the concept does not indicate that he contributed to an increasing hypothetization of science, if this trend is understood in a strong sense, i. e. as the belief that the correctness of scientific theories cannot be established for principled reasons. As mentioned, when it comes to experimental evidence Hertz believes in decisive battles. (shrink)

In this paper I present and assess a controversy between Edmund Husserl and Heinrich Rickert on the nature of judgment, in order to bring to light the originality of Husserl's proposal concerning this important issue. In the first section I provide some context for Rickert's theory of judgment by sketching a reconstruction of nineteenth century logical theory and then proceed to introduce Rickert's view. I suggest that nineteenth century logic is characterized by a criticism of the traditional view that (...) sees categorial judgment as the essential form of judgment and the uniting and separating of ideas as sufficient for the constitution of a judgment. Hume inaugurates this criticism, but it finds its most mature expression in the work of Lotze, Brentano, and Rickert. Rickert, in particular, sees simple affirmation and negation of the transcendent value of truth as the essence of judgment. In the second section I present Husserl's criticism of Rickert. Husserl's criticism revolves around the distinction between simple judgments and the higher-order affirmative or negative stance we can adopt with respect to previously articulated simple judgments. Simple judgments register the mereological relation holding among something and one of its properties, and they do not entail an affirmative or negative stance. Their function is to constitute states of affairs drawing on concrete perceptual situations. Higher-order affirmation or negation occurs when we set out to revisit a foregoing simple judgment in order to confirm or disconfirm the veridicality of its proposed state of affairs. In the third part I suggest a diagnosis of the origin of the mistake in earlier theories. Simple judgments are easy to conflate with non-simple, higher-order judgmental stances because they have the same logical value and they cannot be seen without the aid of genuinely phenomenological reflection. In conclusion, I suggest that Husserl's analysis amounts to a vindication of categorial judgment in its traditional form ‘S is P’, which continues to maintain a phenomenological legitimacy even in the wake of Frege's canonical dismissal of subject and predicate. In international social science’s debate on power and rulership, Max Weber occupies a dominant position. There is hardly a study on power or rulership that does not refer to him, be it critical or affirmative. The sustainable success of Weber’s concept of power is based not least on the fact that he took up contemporary Nietzschean voluntaristic ideas and combined them with an action-related perspective. In doing so, he revolutionized the theory of power. This goes particularly for his category of (...) “chance”, with which he indicated power as a gradual and quantifiable phenomenon. The effect of this approach was so striking that it is still the most influential concept of power, shaping theorists like Hannah Arendt, Raymond Aron, and Heinrich Popitz. Furthermore, Weber moved the concept of rulership, as an institutionalised and reinforced form of power, into the focus of social sciences, providing a large-scale sociology of rule, which exposes the various types and motives of obedience. At the same time, however, the reception of the conceptual pair of power and rulership reveals a paradoxical phenomenon, since the two concepts are received worldwide, while they are still often used arbitrarily and regularly mixed up. Although the Philosophy for/with Children (P4wC) movement seems to have overcome two major points of criticism, these critical concerns can still be found in the literature today. The first question is whether P4wC can be placed in the field of philosophy at all, and the second asks whether children possess the cognitive abilities necessary to engage in philosophical discourse. One of the more recent articles voicing these concerns is authored by Caroline Heinrich, who describes P4wC as “an assault on (...) philosophy and an assault on children” and argues that P4wC is a “concept imposed by adults on children.” She maintains that P4wC ignores “children’s thinking, questioning and play.” Furthermore, Heinrich states that P4wC cannot be called philosophy because children are not able to philosophize. In most of her argumentation, refering to Jan Piaget’s theoretical account of the cognitive development of children. Although the P4wC discourse has already dealt with these questions over the last few decades, it seems that there is still a need for further clarification. This paper provides an overview of the main points of criticism, which form the starting point of the author’s Polylogical Process Model of (Elementary-)Philosophical Education (PPEE model). This interdisciplinary approach, which is based on the constructivist conceptual change/growththeory of Stella Vosniadou and William Brewer, attempts to add new perspectives to two central questions addressing the P4wC movement: first, can P4wC actually be called philosophy?; second, do children have the cognitive abilities to engage in philosophical discourse? In addition, the question arises as to which pedagogical considerations based on constructivist learning theory could be added to P4wC methodology? The aim of the interdisciplinary PPEE model is to build a broader scientific foundation that has the potential to reduce the main points of criticism of the P4wC movement. (shrink)

Finite model theory is currently not one of the hot topics in the philosophy and history of mathematics, not even in the philosophy and history of mathematical logic. The philosophy of mathematics and mathematical logic has concentrated on infinite structures, closely related to foundational issues. In that context, finite models deserved only marginal attention because it was taken for granted that the study of finite structures is trivial compared to the study of infinite structures. In retrospect, research on finite structures (...) turned out to be neither trivial nor irrelevant but had an important impact on theoretical computer science. A closer look at the early history of the spectrum problem shows that the birth of finite model theory has roots in formal logic, at a time when computer science did not yet exist. (shrink)

Simplicity can be a complicated matter. This has been notorious in the philosophy of science for some time; but it seems the aesthetics of music yet have to come up to that insight. Song, apparently the plainest of musical genres, turns out to be a rather intricate sort of thing once we try to unravel its puzzle of expression as confluence of words and music. Specifically, Franz Schubert’s Ihr Bild, after Heinrich Heine, achieves simplicity through condensation. In this paper I discuss Jaspers’ theory of worldviews with regard to the contemporary problem of naturalism. In particular, I consider the frequent characterization of naturalism as a worldview. First, I situate Jaspers’ conception of worldviews in the context of the philosophical debate of his time. I then turn to Jaspers’ distinction between substantial worldviews and derivative shapes of worldviews and present his construal of naturalism as a derivative shape of what he calls the sensory- spatial Weltbild. I then argue (...) that contemporary naturalism still fits Jaspers’ description and can thus be considered a derivative shape, rather than a genuine worldview in its own right. I draw on some writings by Heinrich Rickert and Wilhelm Dilthey to further substantiate my claim. I conclude by arguing that if naturalism wishes to present itself as a worldview it should orient itself toward our human experience of nature. (shrink)

In an influential article, Gerd Grasshoff has argued for the identification of the objects in Wittgenstein's Tractatus with the ultimate constituents of reality in Heinrich Hertz's Principles of Mechanics. Grasshoff's interpretation is based on two interrelated claims: The specific determination of the objects in the world and the relation among them is the primary theme in Wittgenstein's early philosophy, because it is the primary theme for Hertz. Wittgenstein did not assume the existence of simple objects on purely logical grounds (...) without having specific examples of simple objects in mind, because Hertz did not do this. (shrink)

Both Andreas Libavius and Heinrich Khunrath graduated from Basel Medical Academy in 1588, though the theses they defended reveal antithetical approaches to medicine, despite their shared interests in iatrochemistry and transmutational alchemy. Libavius argued in favour of Galenic allopathy while Khunrath promoted the contrasting homeopathic approach of Paracelsus and the utility of the occult doctrine of Signatures for medical purposes. This article considers these differences in the two graduates' theses, both as intimations of their subsequent divergent notions of (...) the boundaries of alchemy and its relations with medicine and magic, and also as evidence of the surprisingly unstable academic status of Paracelsian philosophy in Basel, its main publishing centre, at the end of the sixteenth century. The aim of the present paper is to analyse compactness properties of nonmonotonic inference operations within the framework of model theory. For this purpose the concepts of a deductive frame and its semantical counterpart, a semantical frame are introduced. Compactness properties play a fundamental in the study of non-monotonic inference, and in the paper several new versions of compactness are studied.

Anche se siamo comunemente abituati a pensare alla scienza come a un qualcosa di assolutamente atemporale e indipendente da tutto, in realtà essa è profondamente influenzata dalla cultura e dalla società del tempo in cui vive. Infatti né la scienza è isolabile dalla società, né la società è isolabile dalla scienza, tanto meno come si sta configurando oggi. Per approfondire questi aspetti, esistono però due visioni antagoniste che bisogna superare: secondo la visione scolastica, retaggio del positivismo ottocentesco ancora molto diffuso (...) fra scienziati e pubblico di non esperti, la scienza è conoscenza senza soggetto conoscente. All'opposto, la visione cinica della scienza, sull'onda di talune elaborazioni della sociologia della scienza, la riduce a nient'altro che a una costruzione di soggetti che partecipano al gioco scientifico, una cultura come altre e da "mediare", e comunque una conoscenza relativa, se non frutto di una costruzione puramente soggettiva, arbitraria, ideologica. Un'analisi della costituzione sociale della scienza può, invece, mirare a un'indagine scientifica sulla scienza proprio configurando una relatività della conoscenza che supera sia l'assolutismo idealistico sia il relativismo soggettivistico. Heinrich Rickert (1863-1936) war einer der bedeutendsten deutschen Philosophen vor dem Zweiten Weltkrieg und gilt neben Wilhelm Windelband als einer der Hauptvertreter der südwestdeutschen Schule des Neukantianismus. Seine auch heute noch anregende Philosophie hatte großen, interdisziplinären wie internationalen Einfluss. Die philologisch-kritische Ausgabe macht die Schriften endlich wieder verfügbar.

In Phenomena of Power, one of the leading figures of postwar German sociology reflects on the nature, and many forms of, power. For Heinrich Popitz, power is rooted in the human condition and is therefore part of all social relations. Drawing on philosophical anthropology, he identifies the elementary forms of power to provide detailed insight into how individuals gain and perpetuate control over others. This book is the culmination of Heinrich Meier's acclaimed analyses of the controversial thought of Carl Schmitt. This book, by one of the most prominent interpreters of Leo Strauss's thought, was the first to address the problem that Leo Strauss himself said was the theme of his studies: the theologico-political problem or the confrontation with the theological and the political alternative to philosophy as a way of life. In his theologico-political treatise, which comprises four parts and an appendix, Heinrich Meier clarifies the distinction between political theology and political philosophy and reappraises the unifying center of Strauss's (...) philosophical enterprise. The book is the culmination of Meier's work on the theologico-political problem. It will interest anyone who seeks to understand both the problem caused by revelation for philosophy and the challenge posed by political-religious radicalism. The aim of this book is to expound Kant’s _Critique of Judgement _by interpreting all the details in the light of what Kant himself declares to be his fundamental problem. _A Commentary on Kant’s Critique of Judgement _provides an excellent introduction to Kant’s third critique, and will be of interest to students of philosophy.

Although Schmitt never answered Strauss publicly, in the third edition of his book he changed a number of passages in response to Strauss’s criticisms.

Confronted with mounting pressure to ensure accountability vis-à-vis customers, citizens and beneficiaries, organizational leaders need to decide how to choose and implement so-called accountability standards. Yet while looking for an appropriate standard, they often base their decisions on cost-benefit calculations, thus neglecting other important spheres of influence pertaining to more broadly defined stakeholder interests. We argue in this paper that, as a part of the strategic decision for a certain standard, management needs to identify and act according to the needs (...) of all stakeholders. We contend that the creation of a dialogical understanding among affected stakeholders cannot be a mere outcome of applying certain accountability standards, but rather must be a necessary precondition for their use. This requires a stakeholder dialogue prior to making a choice. We outline such a discursive decision framework for accountability standards based on the Habermasian concept of communicative action and, in the final section, apply our conceptual framework to one of the most prominent accountability tools (AA 1000).
